3. General Principles

3.1 What data do we collect and from whom?

Primarily, we process personal data that you provide to us or that we collect during the operation of our website. In some cases, we may also receive personal data about you from third parties. These may include the following categories:

  • Basic personal data (name, address, date of birth, etc.);
  • Contact information (mobile number, email address, etc.);
  • Financial data (e.g., account details);
  • Online identifiers (e.g., cookie IDs, IP addresses);
  • Location and traffic data;
  • Audio and visual recordings;
  • Special categories of personal data (e.g., biometric data or health information).

3.2 Under what conditions do we process your data?

We treat your data confidentially and in accordance with the purposes defined in this Privacy Policy. We ensure transparency and proportionality in data processing.

If, in exceptional cases, we are unable to adhere to these principles, the data processing may still be lawful if there is a legitimate legal basis. Such a basis may include:

  • Your consent;
  • The performance of a contract or pre-contractual measures;
  • Our legitimate interests, provided they do not override your interests.

3.3 How can you withdraw your consent?

If you have given us consent to process your personal data for specific purposes, we will process your data based on that consent, unless we have another legal basis.

You may withdraw your consent at any time by sending an email to the address listed in the legal notice. This does not affect data processing that has already occurred.

3.4 In which cases do we share your data with third parties?

a. General

We may rely on third-party services or affiliated companies to process your data (known as processors). Categories of recipients include:

  • Accounting, fiduciary, and auditing firms;
  • Consulting firms (legal, tax, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Payment service providers;
  • Providers of tracking, conversion, and advertising services.

We ensure that these third parties and our affiliates comply with data protection requirements and treat your personal data confidentially.

In some cases, we may also be legally obliged to disclose your personal data to authorities.

b. Visiting our Social Media Channels

We may include links to our social media channels on our website, which are clearly identifiable (typically via icons). Clicking on these icons will redirect you to our social media channels.

In doing so, social media providers may become aware that you are accessing their platform from our website. They may use the collected data for their own purposes. We have no knowledge of the content or use of the transmitted data by the platform operators.

c. Data Transfers Abroad

In some cases, your personal data may be transferred to companies abroad as part of data processing. These companies are subject to the same level of data protection as we are. Transfers can occur worldwide.

If the level of data protection is not equivalent to that in Switzerland, we conduct a prior risk assessment and ensure contractual safeguards to guarantee equivalent protection (e.g., using the EU Commission’s Standard Contractual Clauses or other legally mandated measures). If our risk assessment is negative, we implement additional technical measures to protect your data. You can access the EU Commission’s Standard Contractual Clauses here: https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_en

3.5 How long do we store your data?

We store personal data only as long as necessary to fulfill the specific purposes for which it was collected.

Data collected during your visit to our website is stored for twelve months. An exception applies to analytics and tracking data, which may be retained longer.

Contractual data is retained longer due to legal requirements. For example, we must retain business communications, signed contracts, and booking records for up to 10 years. If we no longer need such data for service provision, it is restricted and used solely for accounting and tax purposes.

3.6 How do we protect your data?

We store your data securely and take all reasonable precautions to protect it from loss, unauthorized access, misuse, or alteration.

Our partners and employees who have access to your data are obligated to comply with data protection laws. In some cases, we may need to forward your request to affiliated companies. Your data will still be handled confidentially in such cases.

On our website, we use SSL (Secure Socket Layer) encryption in conjunction with the highest level of encryption supported by your browser.

3.7 What rights do you have?

a. Right to Access

You may request information about the personal data we have stored about you at any time. Please send your request along with proof of identity to email@mail.ch.

You also have the right to receive your data in a commonly used file format if we process your data automatically and if:

  • You have consented to the processing; or
  • You have disclosed the data in connection with a contract.

We may restrict or refuse access if it conflicts with legal obligations, our own or public interests, or the rights of third parties.

Your request will be processed within the statutory period of 30 days. This deadline may be extended due to high volumes, legal or technical reasons, or if we require further details. You will be informed of any extension in a timely manner, at least in text form.

b. Deletion and Correction

You may request the deletion or correction of your data at any time. We may deny such requests if we are legally required to retain the data for a longer period or if other legal grounds oppose your request.

Please note that exercising your rights may conflict with contractual agreements and affect contract execution (e.g., early termination or cost consequences).

c. Legal Remedies

If you are affected by the processing of personal data, you have the right to seek legal remedy or to lodge a complaint with the competent supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner: https://www.edoeb.admin.ch

3.8 Changes to this Privacy Policy

We may change this Privacy Policy at any time. Changes will be published on webseite.ch and you will not be notified separately.

4. Individual Data Processing Activities

4.1 Provision of the Website and Creation of Log Files

What information do we receive and how do we use it?

By visiting webseite.ch, certain data is automatically stored on our servers or on servers of services and products we use and/or have installed. This is for system administration, statistical purposes, security purposes, or tracking. This includes:

  • The name of your internet service provider;
  • Your IP address (possibly);
  • The version of your browser software;
  • The operating system of the computer used to access the URL;
  • The date and time of access;
  • The website from which you visited the URL;
  • The search terms you used to find the URL.

Why are we allowed to process this data?

This data cannot be assigned to specific individuals and is not combined with other data sources. Log files are stored to ensure the functionality of the website and the security of our IT systems. This constitutes our legitimate interest.

How can you prevent data collection?

Data is only stored for as long as is necessary to achieve the purpose of its collection. Accordingly, the data is deleted at the end of each session. The storage of log files is essential for the operation of the website; therefore, you cannot object to this.

4.2 Google Ads

We use Google Ads, an online advertising service by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Ads allows us to place advertisements in Google search results and across the Google advertising network.

4.3 Google Ads Conversion Tracking

We use the “Google Ads” online advertising program and, in this context, conversion tracking (tracking of actions). Google Ads Conversion Tracking is an analytics service by Google LLC.

When you click on an ad placed by Google, a cookie is set on your device for conversion tracking. These cookies have a limited lifespan, do not contain personal data, and are not used for personal identification. If you visit specific pages on our site and the cookie is still valid, Google and we can recognize that you clicked the ad and were redirected to this page.

The information collected via the conversion cookie is used to compile conversion statistics. We learn the total number of users who clicked on our ad and were redirected to a page tagged with a conversion tracking tag. However, we do not receive any information that can identify users personally.

You can prevent cookie storage by adjusting your browser settings accordingly. Note that you may not be able to use all functions of our website in full. In this case, you will not be included in conversion tracking statistics.

You can also deactivate personalized advertising in your Google Ads settings. Instructions are available at: https://support.google.com/My-Ad-Center-Help/answer/12155764.

4.4 Meta Ads

Our website uses Meta Ads, an online advertising service provided by Meta Platforms, Inc., 1601 Willow Road, Menlo Park, CA 94025, USA (formerly Facebook, Inc.). Meta Ads enables us to place targeted ads to draw attention to our products or services.

When you visit our website, a cookie may be placed on your device via Meta Ads that allows the analysis of your website usage. Meta can also track your user behavior across different websites and devices and serve personalized ads based on this data.

The data collected by the cookie is transmitted to and stored by Meta. Meta may link this data with your Meta account (formerly Facebook account) and use it for its own advertising purposes.

You can object to the use of cookies on your device by configuring your browser settings to block cookies or delete existing ones. However, disabling cookies may result in reduced functionality of our website.

More information on how Meta handles user data can be found in Meta’s privacy policy: https://www.facebook.com/privacy/policy/. If you do not want Meta to use your data for advertising, you can adjust the relevant settings in your Meta account.

4.5 Google Analytics

We use Google Analytics, a web analysis service from Google LLC. Google Analytics uses “cookies”, which are text files stored on your computer that enable an analysis of your website usage.

The information generated by the cookie about your use of the website is generally transmitted to a Google server in the USA and stored there. If IP anonymization is activated on this website, your IP address will first be shortened by Google within the EU or EEA. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

On behalf of the website operator, Google uses this information to evaluate your use of the website, compile reports on website activity, and provide other services related to website and internet use.

The IP address transmitted by your browser as part of Google Analytics is not merged with other data by Google.

You can prevent the storage of cookies by adjusting your browser software settings. Additionally, you can prevent Google from collecting and processing the data generated by the cookie related to your website usage (including your IP address) by downloading and installing the browser plugin available at: https://tools.google.com/dlpage/gaoptout.

4.6 Google Tag Manager

We use Google Tag Manager, a service by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”), to manage website tags via an interface. Google Tag Manager itself (which deploys the tags) is a cookie-less domain and does not process personal data. The service triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If deactivation has been made at the domain or cookie level, it remains in effect for all tracking tags implemented with Google Tag Manager.

Using Google Tag Manager, scripts (so-called tags) are automatically activated on our website, and data may be transmitted from your browser to Google. This data can include information about your IP address, the browser you use, pages you visit on our site, and other interactions during your visit.

4.7 Google Tag Manager for WordPress

We use the “Google Tag Manager for WordPress” plugin, which integrates Google Tag Manager into our WordPress-based website. Google Tag Manager is a service by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). This plugin allows us to manage and embed various scripts and codes via a central interface.

Google Tag Manager itself is a cookie-less domain and does not process personal data. It triggers other tags that may collect data. Google Tag Manager does not access this data. If a deactivation has been made at the domain or cookie level, it remains valid for all tracking tags implemented via Google Tag Manager.

By using this plugin, scripts (tags) may be activated automatically on our website, and data such as your IP address, browser type, pages visited, and other interactions may be transmitted from your browser to Google.

4.8 Microsoft Clarity

Our website uses Microsoft Clarity, a web analytics service from Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA. Microsoft Clarity helps us better understand user behavior on our website by recording interactions such as clicks, scrolls, and mouse movements. This allows us to improve the user experience.

Microsoft Clarity uses cookies and other technologies to collect data such as IP addresses, browser types, operating systems, visited pages, session durations, and similar information. This data is anonymized and used to identify usage trends and continuously improve our website.

Microsoft stores this data securely and implements appropriate privacy safeguards to protect it from unauthorized access. The data is not used to personally identify individual users.

4.9 Cart Functionality

Our website offers a cart functionality, allowing visitors to select products or services and earmark them for purchase. During this process, data such as selected items, quantity, and total price may be stored.

To facilitate the purchasing process, we may also store information such as your name, shipping and billing address, email address, and other relevant purchase data. This information is used to simplify the purchasing experience and ensure a seamless transaction.

Data collected through the cart functionality is stored on our servers and is only accessible to authorized personnel involved in order processing and management. This data will not be shared with third parties without your explicit consent, unless legally required or necessary for contract fulfillment (e.g., shipping via third-party providers).

To improve user experience, we also use cookies that allow the contents of your cart to be stored even after you leave the website. These cookies can be deleted or blocked at any time via your browser settings.

4.10 Google Pay

We offer Google Pay as a payment option, a service by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Pay enables you to make payments using stored payment methods in your Google account without re-entering the details on our site.

If you choose Google Pay, certain transaction data, including details of the purchased item or service and the transaction amount, are transmitted to Google. Google may also collect information such as your IP address or device-related data.

Google uses this data to process the payment, prevent fraud, and improve its services. The data may be combined with other data collected through your use of other Google services.

4.11 WooCommerce

WooCommerce is open-source software developed by Automattic, Inc., located at 60 29th Street #343, San Francisco, CA 94110, USA. WooCommerce is an e-commerce platform that enables us to offer products and services through our website.

We use WooCommerce to manage our online store. This includes product display, order processing, payment handling, and inventory management. The following personal data may be collected and processed when using WooCommerce:

  • Order data: Product information, order numbers, transaction details, and shipping status.
  • Customer data: Personal data such as name, email address, shipping and billing address, and phone number.
  • Payment data: Payment details are securely transmitted to the payment service providers we use. WooCommerce itself does not store complete payment information.
  • Technical data: IP address, browser type and version, and other technical information necessary for the website’s functionality and security.

The data is used for the following purposes:

  • Order processing and shipping
  • Payment handling and fraud prevention
  • Customer support and service

Our website is based on the WordPress platform, a content management system developed by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. WordPress allows us to create, manage, and publish content.

When using our WordPress-based website, data such as your IP address, access date and time, and information about your browser may be collected and stored. This data is primarily used for administrative purposes and to ensure the website functions correctly.
